These terms form an agreement between you and [LEGAL_ENTITY_NAME] for your use of Photique. By using the service, you accept these terms and the Privacy Policy. Russian version: Terms.
1. Service and account
The service receives a photo, sends it to selected AI providers, and produces a critique, edit/reshoot instructions, and sometimes generated images. An account is required for the private library. You are responsible for your sign-in and activity through your session. The service is for adults aged 18 or older.
2. Your content and permissions
You retain your rights in your input and represent that you have the rights and permissions needed to upload and process it, including a lawful basis for photos of other people. You grant us a limited, non-exclusive license only to receive, copy, store, transmit to disclosed processors, transform, and display inputs and outputs to provide the service. This license does not permit sale, advertising use, training our own models, or display to other users without separate consent. Gallery publication requires a fresh, versioned public-web per-photo opt-in that expressly covers anonymous access, a selected scope, and an unpublish right.
The current localhost beta gallery is anonymously readable and always shows four explicitly approved, curated, metadata-stripped examples. It does not scan user projects: they remain private by default and appear only after the opt-in described above. Older authenticated-gallery consent is not grandfathered.
3. AI output
As between you and us, you may use output to the extent allowed by law and the applicable model provider terms. Output may be inaccurate, non-unique, similar to output produced for others, or not protected by copyright. Critiques are probabilistic model output, not professional advice. Do not use the service for medical, legal, biometric, employment, credit, insurance, or other decisions with significant legal effects.
4. Prohibited use
- Illegal content or infringement of copyright, privacy, publicity, or other rights.
- Non-consensual intimate images, sexual exploitation, or any sexual content involving minors.
- Fraud, harassment, hate, credible threats, impersonation, or harmful deepfakes.
- Circumvention of safety controls, authentication, quotas, abuse limits, or provider restrictions.
- Malware, scraping other accounts, or attempts to access another user's private artifacts.
We may refuse processing, restrict access, remove clearly unlawful content, and preserve required evidence.
5. Gallery and shared content
Gallery publication is always optional and private is the default. Anonymous visitors may read the gallery; publishing and liking require sign-in. A user photo is published only as an owner-approved, metadata-stripped copy after a fresh, versioned public-web per-photo opt-in that expressly covers anonymous access. The owner can unpublish it without deleting the private project; this revokes new access through the app but cannot recall copies that visitors already saved. Reporting, blocking, and a moderation process are not yet available, so external public-community deployment remains blocked.
6. Purchases, subscriptions, and refunds
Price, currency, taxes, billing period, included credits, renewal, and trial terms are shown before purchase and supplemented by Payments & Refunds. Digital features in iOS use Apple In-App Purchase unless a lawful exception applies. Apple administers billing, cancellation, and refund eligibility for App Store purchases. Web purchases use the provider named at checkout; we do not receive full card details. Mandatory consumer rights remain unaffected.
7. EU withdrawal
Where a 14-day withdrawal right applies, checkout explains when performance begins. Separate express consent to immediate performance and acknowledgement of any loss of withdrawal rights are requested where required. This does not waive remedies for a digital service that was not delivered or does not conform to the contract.
8. Availability and termination
The service depends on hosting, authentication, and AI providers; continuous availability and identical output are not guaranteed. We may change models, limits, and features, but will not impose a new price or materially reduce a paid entitlement without any notice or consent required by law. Account deletion does not automatically cancel an Apple subscription; use Manage Subscription first.
9. Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, or lost-profit damages or decisions based solely on AI output. Aggregate contractual liability is limited to amounts you paid for the service in the 12 months before the event, unless mandatory law requires otherwise. Nothing excludes non-excludable liability or mandatory consumer rights.
10. Law, Apple, and contact
These terms are governed by [GOVERNING_LAW], without depriving consumers of mandatory protection in their country of residence. For App Store downloads, Apple's Standard EULA governs the app license unless a custom EULA is published; these terms govern the account and online service.
